Notice to Contractors
Subject: Binding Interpretation No. 318
Applicability (DS 2026-025 & DS 2026-026)
All Contractors
This notice addresses the issuance of Declaratory Statements DS 2026-025 and DS 2026-026 and clarifies their relationship to Binding Interpretation No. 318, particularly with respect to threshold buildings, inspection requirements, and permit applicability.
These Declaratory Statements provide clarification relevant to the application of Binding Interpretation No. 318, particularly in distinguishing between:
- Work that constitutes structural modification versus like-for-like replacement;
- Projects that trigger structural special inspection requirements under Section 110.8.1; and
- New threshold building construction versus alteration or replacement work under Section 110.8.5.
To provide additional clarity:
- Like-for-like/ size-for-size window, door, or shutter replacements do NOT require a General Contractor (CGC) to obtain the permit, a structural inspection plan prepared by a licensed engineer or architect, or inspection by a threshold (special) inspector. Inspections will be completed by a city inspector or if applicable, the private provider inspector for the permit.
- Work involving alterations to structural members requires a CGC permit holder, a structural inspection plan prepared by a licensed engineer or architect, and inspection by a threshold (special) inspector.
- Lanai enclosures in threshold buildings that are not like-for-like or size-for-size are considered structural modifications and therefore trigger threshold inspection requirements.
- Installation of new shutters in threshold buildings that are not like-for-like or size-for-size are considered structural modifications and therefore trigger threshold inspection requirements.
- Threshold inspection plan requirements shall apply to all new plumbing penetrations, electrical conduit trenches, and slab cuts within threshold buildings.
For permits currently in Active status that include the Threshold Letter inspection, please contact us at gpcommercial@mygulfport.us to request removal of this inspection. The Window/Door Final inspection will be added in its place and will be performed by a City inspector or, where applicable, a private provider inspector.
- This guidance applies only to projects involving like-for-like, size-for-size replacements where no structural alterations are proposed or performed.
For questions related to this notice, please contact the permit counter at gpcommercial@mygulfport.us or
